1. Acceptance of Terms
By accessing or using AssetFlow ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
AssetFlow is a cloud-based physical asset management platform designed for facilities and property teams. The Service includes asset tracking, work order management, preventive maintenance scheduling, compliance reporting, and related analytics tools. Features and availability may vary by subscription plan.
3. Accounts and Registration
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Subscription and Billing
AssetFlow is offered on a subscription basis. Fees are charged in advance on a monthly basis and are non-refundable except as required by law. We may change subscription fees upon notice to you. Changes will take effect at the start of the next billing cycle.
5. Free Trial
New users may access a 30-day free trial with full Pro features. No credit card is required to start the trial. At the end of the trial period, you may select a paid plan to continue using the Service. Your data will be retained for a reasonable period after trial expiration.
6. Acceptable Use
You agree not to use the Service to: (a) violate any applicable law or regulation; (b) infringe upon the rights of others; (c) transmit any malicious software or harmful code; (d) interfere with the integrity or performance of the Service; or (e) attempt to gain unauthorized access to the Service or its related systems.
7. Data and Content
You retain ownership of all data and content you submit to the Service ("Your Content"). By uploading Your Content, you grant AssetFlow a limited license to host, store, and process it solely for the purpose of providing and improving the Service.
8. Intellectual Property
The Service and its original content, features, and functionality are owned by AssetFlow, Inc. and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without express written permission.
9. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may cancel your subscription at any time through your account settings.
10. Limitation of Liability
To the maximum extent permitted by law, AssetFlow, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page with a revised date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of New South Wales.
